Terms of Service

EventRentalOS is operating software for event rental businesses. It provides, among other things, a booking website, inventory and availability management, quotes and orders, customer records, payment collection, notifications, and fulfillment tools. Rental businesses that create a workspace on the platform are “Operators”; the people who browse an Operator’s storefront or rent from an Operator are that Operator’s customers, not ours.

The Service, including hosted storefronts, includes Google Maps features and content for address suggestions and maps. Your use of Google Maps features and content is subject to the then-current Google Maps/Google Earth End User Additional Terms and the Google Privacy Policy. If you do not comply with those terms, we may suspend or terminate your access to Google Maps features and content in the Service.

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for activity under your account and for the people you invite to your workspace, including the roles and permissions you assign them. You must be at least 18 years old and able to form a binding contract to use the Service.

Paid plans are billed monthly at the price disclosed when you select the plan and on the Billing page of your dashboard. Prices are stated in U.S. dollars and exclude applicable taxes. A payment method is collected through Stripe Checkout and your subscription renews automatically until canceled. There is no default free trial. If EventRentalOS makes a promotion code available, its discount and duration are disclosed at Checkout; a promotion that discounts the first month may still require a payment method for later renewals.

Plan upgrades and paid add-on additions take effect immediately and may result in a prorated charge. Plan downgrades, paid add-on removals, and cancellation take effect at the end of the current billing period, so you retain the corresponding features through that date. You can manage your payment method, cancellation, and an eligible scheduled renewal from the Billing page.

We may change plan pricing or included features with at least 30 days’ notice, effective at your next renewal.

You retain all rights to the content and data you and your customers submit to the Service — catalog items, photos, orders, customer records, documents, and site content (“Operator Content”). You grant us the license needed to host, display, transmit, and back up Operator Content in order to run the Service, including publishing the storefront pages you choose to publish. You are responsible for having the rights to the content you upload and for complying with laws that apply to your customer data.

Payment processing for Operator storefronts is provided by third-party processors (currently Stripe) under their own terms. EventRentalOS is not a party to rental agreements between Operators and their customers and does not hold customer funds. Operators create a Stripe connected account through EventRentalOS, receive direct charges to that account, and remain responsible for rental disputes, damage claims, refunds, deposits, and payment disputes. Depending on the selected plan, EventRentalOS may collect the transaction fee disclosed in the plan comparison as a Stripe application fee on a customer payment.

If your plan includes email or SMS notifications, you may only send messages to recipients who have consented to receive them, and you must honor opt-outs. Text messaging is subject to carrier registration and compliance requirements; you agree to provide accurate registration information and to use messaging only for the transactional purposes it is enabled for.

EventRentalOS account users may separately opt in to two direct account messaging programs from Account > Text message preferences. Marketing textsmay include product updates, promotional offers, and event-rental business tips, with frequency varying up to 4 messages per month. SMS Authenticationsends one-time authentication and account-verification codes requested by or triggered for the enrolled account; frequency varies with account activity. Each program has its own optional mobile-number field, consent checkbox, and save action. Selecting one does not enroll you in the other.

Consent to either account program is not a condition of purchasing or using EventRentalOS. Standard message and data rates may apply. Reply STOP or UNSUBSCRIBE to opt out of account-program texts, START or YES to resume them, or HELP for help. You may also change either program independently in the dashboard or contact support@eventrentalos.com. Carrier delivery is not guaranteed. If you separately opt in to the EventRentalOS transactional SMS program through an Operator’s storefront, you authorize EventRentalOS to send text messages to the number you provide about your transaction with that Operator. Messages may include quote or order confirmations, payment links and receipts, status updates, and pickup, delivery, or return reminders. The applicable Operator may be identified in a message as context for your transaction, but EventRentalOS is the sender of this platform messaging program. This rental-transaction program is not used for the direct account marketing messages described above and retains its own consent record.

Consent to EventRentalOS texts is optional and is not a condition of a purchase or rental. Message frequency varies, and message and data rates may apply. Reply STOP to opt out, START or UNSTOP to opt back in, or HELP for help. You may also contact support@eventrentalos.com. You represent that you are the subscriber or customary user of the number provided and are authorized to consent to messages at that number.

An Operator that obtains and verifies its own dedicated messaging number may offer a separate Operator-branded messaging program. That program is governed by the Operator’s disclosures and consent flow, and the Operator remains responsible for its messages and compliance obligations.

You agree not to:

• use the Service for anything unlawful, deceptive, or infringing;
• probe, disrupt, or overload the Service or access it by automated means other than documented APIs;
• misrepresent your identity or your business, or send spam from the platform;
• upload malicious code or content you don’t have the right to use;
• resell or white-label the Service without our written agreement.

We work to keep the Service available and performant, but it is provided without a guaranteed uptime level. We may modify features over time; if we discontinue a material feature your plan depends on, we will provide reasonable notice.

The Service, including its software, design, templates, and branding, is owned by Things LLC and its licensors. These Terms do not grant you rights to our branding or to use the Service outside of the rights expressly granted.

You may stop using the Service and cancel at any time. We may suspend or terminate access for material violation of these Terms, non-payment after notice, or where required to protect the Service, other customers, or the public. After termination we will make your Operator Content available for export for a reasonable period, unless we are legally required to remove it.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, EventRentalOS will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for claims arising out of or relating to the Service is limited to the amounts you paid us in the 12 months before the event giving rise to the claim.

We may update these Terms from time to time. If a change is material, we will notify account owners by email or in the dashboard before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. The current version is always available at this page’s address.

These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law rules. Disputes will be resolved in the courts located in Florida, and you consent to their jurisdiction.
